01Quotes from the quote engine
The instant-quote engine at /quote produces two different things, and we're explicit about which is which:
- Websites and online stores — fixed quotes. The number the engine shows, and the written quote we email you, is an offer we hold for 30 days from the date on the quote. If the scope we confirm together on a scoping call matches what you ticked, that number goes on your proposal unchanged. Only the signed proposal binds either of us.
- Web apps — estimates. App scope isn't tickbox-enumerable, so the engine shows an honest itemised range, not a binding price. The fixed, scope-locked number for an app comes from a Launchpad Sprint (section 03) or equivalent scoping, in writing, in a signed proposal.
02The scope-lock guarantee
Our fixed quotes are scope-locked: if we misjudge the effort required to deliver the scope written in your proposal, the difference is our cost — not your invoice.
- The lock covers the scope as written in the proposal, including the agreed page list, features and build plan.
- New features, changed requirements or third-party changes outside our control (e.g. a platform or API you rely on changes its pricing or behaviour) are variations — we'll quote them fixed, in writing, before doing them. No surprise invoices.
03Launchpad Sprint terms
- Fee: A$1,500 including GST for websites and online stores, A$3,500 including GST for web apps, payable to confirm your slot.
- Deliverables: as described on the Launchpad Sprint page — for sites and stores, design direction and a confirmed build plan; for apps, a prototype, fixed build quote and build plan.
- Ownership: on payment of the sprint fee, all sprint deliverables are assigned to you (section 05) — whether or not you build with us.
- The 90-day credit: sign a build proposal with Flagship within 90 days of your sprint ending and the full sprint fee is credited against that build's invoice.
- Rescheduling: move your sprint with 5+ business days' notice at no charge. Cancellations before the kickoff workshop are refunded in full, less any third-party costs already incurred.
04Payment
- Build projects are invoiced against milestones set out in the proposal — never 100% up front.
- Invoices are payable within 14 days. We may pause work on accounts more than 14 days overdue, after telling you first.
- All prices are in Australian dollars. GST is stated on every quote and invoice.
- Care plans (from A$190/month) are billed monthly in advance and can be cancelled with 30 days' notice — no lock-in contracts.
05Intellectual property
On full payment for the relevant milestone or deliverable, we assign to you all intellectual property rights in the work we created for you — code, designs, themes, content and documentation — under s196 of the Copyright Act 1968 (Cth), in writing, in the proposal itself.
- Excluded: our pre-existing tools, frameworks and libraries, and third-party/open-source components (which come with their own licences, listed in the build plan). You get a perpetual, royalty-free licence to use them as part of your site or app.
- Platform subscriptions (e.g. Framer, Webflow, Shopify hosting plans) are contracts between you and the platform — we set them up in your name, so you own the account from day one.
- You warrant that material you give us (branding, content, data) doesn't infringe anyone else's rights.
- We may name you and show non-confidential work in our portfolio only with your written consent — and we never invent clients or results.
06Confidentiality
Every engagement, including the Launchpad Sprint, begins with a mutual NDA under Australian law if you want one. Independently of any NDA, we keep your business information, plans and data confidential and use them only to deliver the services. Your quote page lives at a private, unguessable link and is never listed or indexed.
07Warranties & defects
- We warrant delivered work will materially conform to the agreed scope for 90 days after launch — defects in scope are fixed at our cost.
- Third-party platforms and services (Framer, Webflow, WordPress plugins, Shopify, hosting, APIs) are outside our control; we'll deal with them competently but can't guarantee their decisions, uptime or timelines.
- Ongoing maintenance beyond the warranty period is available under a care plan.
08Liability
Subject to that, and to the maximum extent permitted by law: our total aggregate liability under an engagement is capped at the fees you paid under that engagement; neither party is liable to the other for indirect or consequential loss; and each party remains fully liable for breaches of confidentiality, IP infringement, and wilful misconduct. We hold professional indemnity insurance of A$30M and public liability insurance of A$39M.

10Disputes & contact
Talk to us first: hello@flagshipweb.com.au — most issues are fixable inside a week. Formal disputes go to mediation in Sydney before any court proceedings, and the courts of New South Wales have exclusive jurisdiction. These terms don't limit either party seeking urgent injunctive relief.
